European Union Updates EC261 Flight Delay Compensation Rules: How This Affects Travelers

For the first time in over 20 years, the European Union (EU) has updated its policy on air passenger rights and airline liability — and it has been overwhelmingly positive news.

Here’s a look at the updated policies and how it affects travelers moving forward.

Clarity and Transparency for Compensation Claims

The European Union has reached a landmark agreement to strengthen its long-standing air passenger compensation framework, known as EC261 (often referred to as EU261).

EC261 is widely regarded as one of the world’s strongest passenger rights policies. The regulation requires airlines to compensate travelers for delays and cancellations within their control.

Depending on the distance traveled and the extent of the disruption, passengers may receive between €250 (approximately $290) and €600 (approximately $695) in compensation, along with assistance such as rebooking, meals, and accommodation when necessary.

However, things have gotten even better. The deal, struck between the European Parliament and the Council of the European Union, is the first overhaul of EU air passenger rights since 2004.

Under the updated regulations, passengers will benefit from clearer, more transparent processes for claiming compensation for significant flight delays or cancellations.

Airlines will be required to electronically notify eligible passengers of their rights within 96 hours of arrival and to provide guidance on how to submit compensation claims. Airlines will also be required to provide the reason for the disruption, including whether they believe “extraordinary circumstances” exempt them from paying compensation.

Additionally, they must also promptly acknowledge receipt of claims and issue a response within 30 days, either by paying the compensation due or providing a justification for rejecting the claim.

The reforms also strengthen rerouting rights — if an airline cannot provide an alternative itinerary within 3 hours of a disruption, passengers may arrange their own transportation and seek reimbursement. However, reimbursement for self-booked alternatives will be capped at 400% of the original ticket price.

These reforms are expected to take effect in 2027 and will continue to apply to flights within the EU as well as many flights arriving in or departing from the EU.

Cash Compensation Remains Unchanged

Unfortunately, the cash compensation structure has remained unchanged. Compensation amounts depend on both the distance of your flight and the length of the delay:

• For flights of less than 1,500 km (930 miles), passengers are entitled to €250 (about $290) if the delay is at least 2 hours.
• For flights between 1,500 km and 3,500 km (930 to 2,200 miles), passengers are entitled to €400 (about $464) if the delay is at least 3 hours.
• For flights exceeding 3,500 km (2,200 miles), passengers are entitled to €300 (about $348) for delays of 3 to 4 hours and €600 (about $696) for delays of 4 hours or more.
