Privacy Policy of Upgraded Points, LLC.
This Privacy Policy shall be effective as of August 13, 2024.
We at Upgraded Points, LLC (“Upgraded Points”, “we” “us” or “our”) respect and protect the privacy of visitors or users of our Services (“you,” “your” or “customer”). We respect and value the privacy of our customers and have developed this Privacy Policy to demonstrate our commitment to protecting your privacy. This Privacy Policy applies to and describes our information handling practices when you access our services, which include our content located on this website, or any other websites, applications, widgets, email notifications and other mediums, or portions of such mediums (collectively, the “Site(s)”), through which you have accessed this Privacy Policy (referred to collectively hereinafter as “Services”).
These Sites are for a general audience, and we do not knowingly collect personal, or other, information from children under the age of 18. If you are under the age of 18, please do not use our Sites and Services. If we suspect that information provided to us is, in fact, Personal Information (as defined below) of an individual younger than 18 years of age, such information will be deleted, aggregated, or anonymized as soon as possible. Please notify us if you know of any individuals under the age of 18 using our Sites and Services so we can take action to prevent them from accessing our Sites and Services.
1. Acceptance of Terms of Privacy Policy. Upgraded Points is an online publication focusing on travel and travel rewards including frequent flyer miles, credit card points and other travel loyalty programs. Our Privacy Policy applies to everyone who utilizes our Sites and Services. You agree to this Privacy Policy by accepting Upgraded Points Terms and Conditions and by accessing, browsing, or using our Sites or Services. Where we require your consent to process your Personal Information, we will ask for your consent to the collection, use, and disclosure of your Personal Information as described further below. We may provide additional “just-in-time” disclosures or information about the data processing practices of specific Services. These notices may supplement or clarify our privacy practices or may provide you with additional choices about how we process your data. If you do not agree with or you are not comfortable with any aspect of this Privacy Policy, you should immediately discontinue access or use of our Sites and Services.
2. Types of Information That is Collected. We collect several types of information about you and when you access our Sites and Services. Our Sites may collect information that identifies, relates to, describes, references, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer, household, or device (“Personal Information”). Personal Information does not include (i) publicly available information from government records and (ii) deidentified or aggregated consumer information. To access our Sites and Services, we will ask you to provide us with some important information about you. This information is either required by law (e.g., to verify your identity), necessary to provide the requested Services, or is relevant for certain specified purposes, described in greater detail in this Privacy Policy or on our Sites and Services. As we add new features and Services, you may be asked to provide additional information.
Please note that we may not be able to serve you at all, or our Sites or Services may be degraded if you choose not to share certain information with us.
2.1. Information We Collect Directly From You. We collect information directly from you including without limitation:
2.1.1. Identifying Information: We collect information that could identify you such as your name, phone number, email address, and social media handle.
2.1.2. Website Visitor Information: When you visit our Sites, we may collect information about your visit such as your IP address and the pages you visited and when you use our Services, we may collect information on how you use those Services.
2.1.3. Geolocation Information: This includes general information that can help identify your physical location and the approximate location of your electronic devices.
2.1.4. Preference Information: We may infer information about your preferences, characteristics, predispositions, behavior, attitudes, intelligence, abilities, aptitudes, decisions and actions as it relates to your interaction with our Sites and Services.
2.1.5. User-Generated Content Information: We may contain information from any content that you submit to us through our Sites, Services or communications between us.
2.1.6. Other Information. We also collect information such as demographic data, data about your online activity, and other information that is not used to identify you.
2.2. Information We Collect From You Automatically. We collect information about your electronic device’s interactions with our Sites and Services for a variety of purposes. We receive and store certain types of information automatically, such as whenever you interact with the Sites or use the Services. This information helps us address customer support issues, improve the performance of our Sites and Services and provide you with a streamlined and personalized experience. Information collected automatically includes:
2.2.1. Online Identifiers: Browser fingerprint, operating system, browser name and version, and/or your device IP addresses, device type and unique device identification numbers.
2.2.2. Usage Data: Authentication data, security questions, click-stream data and other data collected via cookies and similar technologies. For example, we may automatically receive and record the following information on our server logs:
- How you came to and use the Services;
- How your device interacts with our Sites and Services, including pages accessed and links clicked; and
- Device event information (such as crashes, system activity and hardware settings, browser type, browser language, the date and time of your request and referral URL);
- Internet or network activity information; and
- Other technical data collected through cookies, pixel tags and other similar technologies that uniquely identify your browser.
2.2.3. Social Media Data: Some of our Sites include social media features and links, such as a social bar with icons that link to the Upgraded Points presence on particular sites (for example, the Upgraded Points page on Facebook, X, Instagram and Pinterest). These features may collect your IP address and information on which page you are visiting on our Sites and may set a cookie to enable the feature to function properly. Social media features and widgets either are hosted by another company or are hosted directly on our Sites. Your interactions with these features are governed by the privacy policy of the company providing it.
We may also use identifiers to recognize you when you access our Sites via an external link, such as a link appearing on a third-party site.
2.3. Information Collected From Third Parties. Depending on your use of our Sites and Services, and your interactions with us through Social Media Sites (as defined below), we may obtain data from other third parties including without limitation, your name, email, address, phone number, usage data (e.g., banner ads clicked), and public data (e.g., online posts on Social Media Sites).
2.4. Data Anonymization and Data Aggregation. We may use data we have anonymized and aggregated for any business purpose. Anonymization is a data processing technique that removes or modifies personal information so that it cannot be associated with a specific individual. Except for this section, none of the other provisions of this Privacy Policy applies to anonymized or aggregated customer data (i.e., information about our customers that we combine together so that it no longer identifies or references an individual customer). Upgraded Points may use anonymized or aggregate customer data for any business purpose, including without limitation to better understand customer needs and behaviors, improve our products and services, conduct business intelligence and marketing, and detect security threats. We may perform our own analytics on anonymized data or enable analytics provided by third parties. Types of data we may anonymize include, transaction data, click-stream data, performance metrics, and fraud indicators. Moreover, should you request that your information be deleted in accordance with the policies set forth more fully below, your information will be anonymized or aggregated, which complies with applicable law regarding deletion of personal information.
3. How Information is Collected.
3.1. We collect information from you when you enter it or otherwise provide it in connection with an inquiry into our Services. This information could be provided via an online form or via other means in which you interact with our Sites and Services.
3.2. We collect information from cookies, pixels and other tracking technologies. We use cookies, pixels and similar technologies to record your preferences, track the use of our Sites and collect information. This information may include internet protocol (IP) addresses, browser type, internet service provider (ISP), referring/exit pages, operating system, date/time stamp, clickstream data, and geolocation data. We may combine this automatically collected log information with other information we collect about you. You may choose to set your web browser to refuse cookies, or to alert you when cookies are being sent. If you do so, please note that some parts of our Sites and Services may not function properly. 3.3. From time to time, we may obtain information about you from third party sources. These sources include without limitation:
- Advertising Networks and Analytics Providers: We work with these providers to provide us with de-identified information about how you found our Sites an Services and how you interact with the Sites and Services.
- Third Party Service Providers: Upgraded Points customers who use certain of our Services are subject to third-party privacy policies.
- Information You Provide Through Social Media Sites. You can engage with some of our content, services and other offerings on or through third party communities, forums, social media sites, platforms, services, plug-ins, and applications, and other public online sources (collectively, the “Social Media Sites”). When you link to or interact with our Sites, content, or other offerings through Social Media Sites, you may allow us to receive certain information from your social media account (e.g., name, user ID, email address, profile photo, photos and videos, gender, birthday, location, your friends and their contact details, people you follow and/or who follow you, posts, ‘likes’, or other user-generated content). We may also receive Personal Information from your interaction with our content (e.g., content viewed and information about advertisements you have been shown or have clicked on). By providing your Personal Information or otherwise interacting with our Services through Social Media Sites, you consent to our use of Personal Information from the Social Media Sites in accordance with this Privacy Policy.
4. How Your Information is Used. We may use collected Personal Information to:
- Deliver the products and Services you requested;
- Improve customer service;
- Improve our Sites and Services;
- Carry out analysis and market research;
- Personalize your user experience;
- Respond to calls and messages from you;
- Communicate with you about products or Services that may be of interest to you by email, Social Media Sites, and other notifications where you agree;
- Direct you to websites, widgets, an applications of our partners;
- Complete data rights requests you have made;
- Target advertising to you, on our Sites and other websites, based on data we have collected or created;
- Enable you to use social sharing tools;
- Manage our business and track sales to get paid by our partners;
- Prevent fraud and to secure our business;
- Create reports for internal or external purposes;
- Audit our business and processes;
- Comply with the law, requests or orders from law enforcement, or any legal process;
- Protect the interests of our business and those of our partners and customers; and
- Execute such other purposes not described in this Privacy Policy but which you have consented to and as otherwise permitted by law.
5. Disclosure of Consumer Information to Third Parties. We may disclose your Personal Information as required by law, to provide the Services, and for legitimate business purposes. We may share your Personal Information by disclosing it to a third party for a business purpose. We only make these business purpose disclosures under written contracts that describe the purposes, require the recipient to keep the Personal Information confidential, and prohibit using the disclosed information for any purpose except performing the contract.
- 5.1. Disclosure By Law: You acknowledge and agree that we may disclose information you provide if required to do so by law, at the request of a third party, or if we, in our sole discretion, believe that disclosure is reasonable to (1) comply with the law, requests or orders from law enforcement, or any legal process (whether or not such disclosure is required by applicable law) and (2) protect or defend Upgraded Points, or a third party´s, rights or property.
- 5.2. Lenders. By submitting a request for a credit card or service as offered on the Sites, you signify your agreement to proceed and that you are consenting, acknowledging and agreeing to the disclosure of your information with lenders and/or financial partners within our network. Please be aware that the lenders, other financial partners, and/or other service providers with whom you are provided offers are not provided any Personal Information until you affirmatively accept an offer to apply for a credit card or other service. Once an invitation to accept a credit card offer is submitted, that financial party’s privacy policy and information policy will then control. Please contact each such party directly regarding their privacy and information policies.
- 5.3. Disclosure to Trusted Third Parties By Us: By using our Sites and Services and accepting the Terms and Conditions, you agree to receive various marketing materials from our trusted third parties, including potential lenders and service providers. We are not responsible for the material of the third parties or their actions. Your information may also be shared with third-party contractors that provide services to Upgraded Points and are bound by this Privacy Policy. Your information will be treated as private and confidential by such third parties and not used for any other purpose than you authorize. In addition, from time to time, we may share Personal Information (such as your e-mail) about our user base with carefully selected third parties, so they can offer goods and services that we believe may be of interest to our users. If you do not wish to receive offers from our trusted partners, you can change your email preferences at any time by following the steps outlined in the “Choice/Opt-Out of Marketing Emails” section below.
- 5.4. Service Providers: We disclose your Personal Information with service providers under contract who help with parts of our business operations. Our contracts require these service providers to only use your information in connection with the services they perform for us and prohibit them from selling your information to anyone else. Examples of the types of service providers we may share Personal Information with (other than those mentioned above) include:
- Network infrastructure
- Cloud storage
- Transaction monitoring
- Security
- Customer support
- Internet (e.g., ISPs)
- Data analytics
- Information Technology
- 5.5. Professionals. We disclose your Personal Information with our professional advisors who provide banking, legal, compliance, insurance, accounting, or other consulting services in order to complete third party financial, technical, compliance and legal audits of our operations or otherwise comply with our legal obligations.
- 5.6. Social Networks. We may obtain your Personal Information from Social Media Sites if you interact with us on our social media accounts, platforms and networks, and may share any posts or content that you have tagged us on or relate to our services in our own social media accounts, website or other marketing material.
- 5.7. Third Parties in Connection with a Merger, Acquisition or Other Business Transaction. We may share Personal Information if we are involved in a merger, acquisition, sale of all or a portion of its assets, financings, joint ventures, reorganization, dissolution, liquidation, or other event where we sell or transfer all or a portion of our business assets or equity. We will not provide you with notice before disclosure in such cases.
- 5.8. Miscellaneous. We may disclose your Personal Information for any purpose with which you consent.
6. Updating, Accessing, Retaining, and Deleting Your Information. In general, we retain Personal Information as long as reasonably needed to achieve the purposes outlined in this Privacy Policy or as otherwise set forth on our Sites. There are many factors that we use to determine how long Personal Information is retained, such as:
- the purposes for which the Personal Information was collected, including to provide our products and Services;
- any legal, regulatory or professional requirements that apply to your Personal Information; and
- whether your Personal Information may be relevant to us in protecting our own rights (e.g., applicable statute of limitation periods).
Information collected via technical means such as cookies, web page counters and other analytics tools is kept until otherwise deleted according to our data retention policies.
7. Security. We have taken steps to protect your Personal Information in a commercially reasonable manner. We have extensive security measures in place to protect the loss, misuse and alteration of the information stored in our database. These measures include the use of industry standard encryption methods and administrative access to site data, as well as other proprietary security measures which are applied to all repositories and transfers of user information. We will exercise reasonable care in providing secure transmission of information between your computer and our servers, but given that no information transmitted over the Internet can be guaranteed 100% secure, we cannot ensure or warrant the security of any information transmitted to us over the Internet and hence accept no liability for any unintentional disclosure. In the event there is a data breach at Upgraded Points, Upgraded Points will notify you as soon as reasonably practicable. We will notify you that a breach occurred, and any additional information needed to fulfill our obligation with breach notification laws and regulations.
8. Choice/Opt-Out of Marketing Emails. You may choose to discontinue your use of our services. You may choose to stop receiving marketing emails by following the unsubscribe instruction included in these emails or you can contact us at mail@upgradedpoints.com. You can choose not to provide us with certain information, but this will likely result in the inability to use certain features of the Sites and to obtain the products and Services you are seeking. Certain federal and state regulations require that we maintain a record of your information for certain periods of time. Due to these regulations, we may be unable to completely delete your information from our database until the time requirements of these regulations have expired.
9. International Data Transfers. Our Sites are controlled and operated by us from the United States and is not intended to subject us to the laws or jurisdiction of any state, country, or territory other than that of the United States. Your Personal Information may be stored and processed in any country where we have facilities or in which we engage service providers, and, by using our Sites, you consent to the transfer of information to countries outside of your country of residence, including the United States, which may have different data protection rules than those of your country.
IF YOU ARE A USER ACCESSING OUR SITES FROM ANY OTHER COUNTRY WITH LAWS OR REGULATIONS GOVERNING PERSONAL INFORMATION COLLECTION, USE AND DISCLOSURE THAT DIFFER FROM THE LAWS OF THE UNITED STATES, PLEASE BE ADVISED THAT THROUGH YOUR CONTINUED USE OF OUR SITES, YOU ARE TRANSMITTING YOUR PERSONAL INFORMATION TO THE UNITED STATES AND YOU CONSENT TO THAT TRANSMISSION. ADDITIONALLY, YOU UNDERSTAND THAT YOUR PERSONAL INFORMATION MAY BE TRANSMITTED TO AND PROCESSED IN COUNTRIES (INCLUDING THE UNITED STATES) WHERE LAWS REGARDING PROCESSING PERSONAL INFORMATION MAY BE LESS STRINGENT THAN IN YOUR COUNTRY.
10. Privacy Rights. You may be able to exercise certain rights regarding your Personal Information depending on the applicable state and federal laws. Depending on applicable law where you reside, you may be able to assert certain rights related to your Personal Information identified below. If any of the rights listed below are not provided under law for your operating entity or jurisdiction, Upgraded Points has absolute discretion in providing you with those rights. Your rights to Personal Information are not absolute. Depending upon the applicable law, access may be denied: (a) when denial of access is required or authorized by law; (b) if you are a resident of a state that does not provide for this right; (c) when granting access would have a negative impact on another’s privacy; (d) to protect our rights and properties; or (e) where the request is frivolous or vexatious, or for other reasons.
11. Special Notice to Residents of the European Economic Area (EEA), United Kingdom (UK) and Canada
11.1. Your Rights. In some regions (like the EEA, UK, and Canada), you have certain rights under applicable data protection laws. These may include:
- Access and Portability. You may request that we provide you a copy of your Personal Information held by us. This information will be provided without undue delay subject to a potential fee associated with gathering of the information (as permitted by law), unless such provision adversely affects the rights and freedoms of others. In certain circumstances, you may request to receive your Personal Information in a structured, commonly used and machine-readable format, and to have us transfer your Personal Information directly to another data controller.
- Rectification or Erasure. You have the right to request that we correct any information you believe is inaccurate. You also have the right to request we complete information you believe is incomplete. You may have the right to request that we erase your Personal Information, under certain conditions.
- Withdraw Consent. To the extent the processing of your Personal Information is based on your consent, you may withdraw your consent at any time. Your withdrawal will not affect the lawfulness of Upgraded Points processing based on consent before your withdrawal.
- Restriction of Processing. In some jurisdictions, applicable law may give you the right to restrict or object to us processing your Personal Information under certain circumstances. We may continue to process your Personal Information if it is necessary for the defense of legal claims, or for any other exceptions permitted by applicable law.
11.2. Legal Basis. Data protection laws in the EEA and UK require a “lawful basis” for processing “personal data” (as defined by GDPR). Our legal basis to process your personal data, includes without limitation:
- Necessity – We will process your personal data as necessary to perform our responsibilities under our contact with you (e.g., processing your order and delivering the products you purchase);
- Legitimate Interest – We will process your personal data when we have a legitimate interest in processing your personal data and these interests are not overridden by your rights and interests (e.g., communicating with you regarding changes to our Services or Privacy Policy);
- Consent – If you provide us with your consent to perform a specific processing activity, we will process your personal data to perform such activity (e.g., sending you marketing emails); and
- Legal Obligation – In some cases, we will process your personal data as necessary for compliance with our legal obligations (e.g., responding to a court order).
11.3. How to Make a Privacy Request. You can make privacy rights requests relating to your personal information by contacting us at mail@upgradedpoints.com. When we receive an individual rights request via other intake methods, we may take steps to verify your identity before complying with the request to protect your privacy and security.
11.4. How to Lodge a Complaint. You have the right to file a complaint regarding your Personal Information with a data protection authority if you believe that the use or handling of your Personal Information does not comply with legal requirements. We would, however, appreciate the opportunity to address your concerns before you approach a data protection authority, and would welcome you directing an inquiry first to us by contacting at mail@upgradedpoints.com.
If you are located in the EEA or UK and you believe we are unlawfully processing your personal information, you also have the right to complain to your Member State data protection authority or UK data protection authority.
If you are located in Switzerland, you may contact the Federal Data Protection and Information Commissioner.
If you are located in Canada, you may contact the Office of the Privacy Commissioner of Canada.
12. Special Notice to California, Virginia, Colorado, Connecticut, and Oregon Residents.
This section applies to the Personal Information of natural residents of California, Virginia, Colorado, Connecticut and Oregon to comply with their applicable state’s privacy laws.
12.1. Your Rights. Subject to applicable laws, natural residents of California, Virginia, Colorado, Connecticut and Oregon have the following rights concerning your Personal Information processed by Upgraded Points:
- Know: You have the right to know (i) the categories of Personal Information we have collected about you in the last 12 months; (ii) the categories of sources for the Personal Information we have collected about you in the last 12 months; (iii) our business or commercial purpose for collecting that Personal Information; (iv) the categories of third parties with whom we share that Personal Information; and (v) the specific pieces of Personal Information we collected about you. If we disclosed your Personal Information to a third party for a business purpose, you have the right to know a list of the Personal Information types that each category of recipient received.
- Deletion: You have the right to request that Upgraded Points delete your Personal Information, and Upgraded Points will delete such Personal Information unless it is reasonably necessary for Upgraded Points to maintain your Personal Information in accordance with applicable law.
- Correction: You have the right to request that Upgraded Points correct inaccurate Personal Information, taking into account the nature and purpose of processing the information.
- Access: You have the right to request to access or obtain a copy of the Personal Information that Upgraded Points holds about you
- Non-discrimination: Upgraded Points will not discriminate against a consumer because the consumer exercised any of the consumer’s rights under applicable laws.
12.2. Exercising Your Rights. Residents of California, Virginia, Colorado, Connecticut and Oregon may exercise the rights described above by submitting a verifiable consumer request by following the directions set forth in the section entitled “Contact Information” below.
You are permitted to designate an authorized agent to submit a request for information or deletion on your behalf. The authorized agent may be a natural person or a business entity registered with the Secretary of State of the state that you reside in, and you have authorized to act on your behalf. All requests from an authorized agent must be accompanied by a signed written statement from you which includes your clear authorization and permission for such agent to submit the request under your behalf or power of attorney that complies with applicable law. We may also follow up with you to verify your identity before processing the authorized agent’s request.
12.3. Verifying Your Identity If You Submit Data Requests. If you choose to contact us directly via the designated methods described above to exercise your rights relating to your Personal Information, you will need to:
- Provide enough information for us to reasonably identify you (e.g., your full name and other identifying information that you have provided us or reasonably believe we have); and
- Describe your request with sufficient detail to allow us to properly process and respond to your request.
You acknowledge that we may not be obligated to process your requests if we cannot verify that the person making the request is the person about whom we collected information of or is someone authorized to act on such person’s behalf.
Any Personal Information we collect from you in order to verify your identity in connection with your request will be used solely for the purposes of verification.
12.4. Categories of Personal Information We Collect. For detailed information on the categories of Personal Information that we collect for the past 12 months, please refer to the section entitled “Types of Information That is Collected.”
12.5. Purposes for Processing Personal Information. For detailed information regarding the specific purposes that we use your Personal Information, please refer to the section entitled “How Your Information is Used.”
12.6. Sharing of Personal Data with Third Parties. For detailed information on the categories of third parties to whom we may share and disclose your Personal Information and the purposes for which we share such information, please refer to the section entitled “Disclosure of Consumer Information to Third Parties.”
12.7. Selling, Targeted Advertising, and Profiling. Our use of certain third-party analytic and functionality tools, including those relating to analytics and advertising, and our interactions with Lenders, marketing consultants and advertising platforms, may be considered a “sale” or “sharing” of Personal Information under the privacy laws of California, Virginia, Connecticut, Colorado or Oregon. You may have the right to direct us not to sell or share your Personal Information with third parties for cross-contextual advertising purposes.
To exercise this right, please click on the “Do Not Sell or Share My Personal Information” link which can also be found in the footer of our website and indicate your preference. You can also contact us by following the directions set forth in the section entitled “Contact Information” below. If you are a resident of California or Colorado, you may also opt out of the selling and sharing of your personal information by broadcasting an Opt-Out Preference Signal, such as the Global Privacy Control (“GPC”) (on the browsers and/or browser extensions that support such a signal). If you choose to use the GPC signal, you will need to turn it on for each supported browser or browser extension you use.
The categories of Personal Information that may be involved in disclosures that could be considered “sale”/“sharing” include Identifying Information, Website Visitor Information, Geolocation Information, Preference Information, User Generated Content Information, Other Information, Online Identifiers, Usage Data and Social Media Data (as such terms are further described in the section entitled “Types of Information That is Collected.” Categories of third parties to whom personal information was disclosed to that may be considered a “sale”/“share” of personal information include without limitation: Lenders, Trusted Third Parties, Service Providers, Social Networks, Professionals, Third Parties in Connection with a Merger, Acquisition or Other Business Transaction, and Miscellaneous, as such terms are further described in the section entitled “Disclosure of Consumer Information to Third Parties.”
We do not process Personal Information for the purpose of profiling in furtherance of decisions that produce legal or similarly significant effects concerning consumers. If we later decide to use your Personal Information for automated decision-making and profile purposes, we will inform you of such decision prior to such use and will provide you with an opportunity to exercise your right to opt out of such use.
12.8. Direct Marketing and Do Not Track Signals. Under California’s “Shine the Light” law, California residents may request and obtain a notice once a year about the Personal Information we shared with other businesses for their own direct marketing purposes. Such a notice will include a list of the categories of Personal Information that were shared (if any) and the names and addresses of all third parties with which the Personal Information was shared (if any). The notice will cover the preceding calendar year. To obtain such a notice, please contact us as described below. In addition, under this law you are entitled to be advised how we handle “Do Not Track” browser signals. We do not personally track users of our website over time and across third party websites to provide targeted advertising and therefore do not respond to Do Not Track (DNT) signals.
13. Special Notice to Nevada Residents. Nevada law (SB 220) requires website operators to provide a way for Nevada consumers to opt-out of the sale of certain information that the website operator may collect about them.
