Are you joining the armed forces, or are you currently an active-duty military member? If so, you’ll want to know about a benefit that can positively affect your financial health.

Joining the military is a huge lifestyle commitment, but it can also come with financial challenges. Some of those challenges were acknowledged with legislation that helps protect servicemembers from financial distress while they’re protecting our nation.

The Servicemembers Civil Relief Act (SCRA) applies to the debt you acquired before you joined the military. If you are getting ready to serve or are currently on active duty, you may be able to benefit from the act.

Let’s examine the SCRA, how it works, and how to request any SCRA benefits you may qualify for.

What Is the Servicemembers Civil Relief Act (SCRA)?

The SCRA was established in 1940 to alleviate some of the financial challenges faced by service members. The act protected active-duty military personnel by capping interest rates and imposing a moratorium on foreclosures.

These protections can prove helpful, but the SCRA has a narrow scope, applying only to debt acquired before you become an active duty member. If you’re already on active duty, any new debt you accrue may fall under another act, the Military Lending Act (MLA).

Who Does the SCRA Benefit?

It’s essential to understand who the act applies to and its benefits. Let’s start with who qualifies for the financial benefits of the SCRA.

  • Activeduty members of the Army, Marine Corps, Navy, Air Force, Space Force, and Coast Guard qualify.
  • When serving on active duty, members of the Reserve can qualify.
  • National Guard component members mobilized under federal orders for more than 30 consecutive days qualify.
  • Active-duty commissioned officers in the Public Health Service (PHS) or the National Oceanic and Atmospheric Administration (NOAA) are eligible.

The SCRA does not apply to ROTC or academy cadets. Reserve and National Guard members may qualify but must meet specific requirements to claim relief via the SCRA.

Some benefits may apply to spouses and dependents of qualifying service members. Learn more about the act and who is covered under the SCRA here.

Bottom Line:

The SCRA applies to debt acquired before entering active duty. Active-duty members of the Army, Marine Corps, Navy, Air Force, and Coast Guard, and certain Reserve members when on active duty, can be covered, as well as active-duty commissioned officers in the PHS and NOAA.

Benefits of the SCRA

If you’re eligible for benefits under the SCRA, here is an overview of the perks you can expect to receive.

  • Caps interest rates on debt at 6%: This applies to loans acquired before entering active service, including credit cards, auto loans, student loans, and home loans.
  • Protects against default judgments in civil cases: This applies when you’re being civilly sued and forbids any default judgment against you.
  • Protects against home foreclosure: The SCRA requires lenders to obtain a court order before foreclosing on your property.
  • Protections against property repossession: Lenders must follow specific procedures and obtain a court order before proceeding with any repossession of your property, including a car.
  • No penalty for termination of residential housing and automobile leases: This provision enables eligible individuals called to active duty to terminate their lease without penalty.

It’s worth noting that these are abbreviated descriptions of SCRA benefits. You can learn more about the benefits of the act on the SCRA website.

Hot Tip:

According to provisions in the SCRA, those who signed a lease while on active duty and have received a permanent change of station (PCS) order or an order for a deployment of more than 90 days may also terminate their leases without penalty.

One key element of the SCRA is the 6% interest rate cap. Credit card annual fees are not explicitly addressed in the act but are calculated as part of the 6% rate cap. Card issuers waive annual fees to meet SCRA regulations.

Applying for SCRA Benefits

SCRA benefits only apply to cards you’ve opened before active duty. Therefore, applying for benefits is, unfortunately, a manual process. This is in contrast to using MLA benefits, which may be applied automatically.

Next, we’ll look at an example of how to apply for benefits with a specific card issuer, American Express. While you can request benefits by mail, fax, or phone, the fastest way is to apply online.

To request SCRA benefits with American Express, for example, you need to log in to your account. Navigate to “Account Services” at the top of the page, then click on “Payment or Credit Options.”

Select “SCRA Benefits” to be taken to Amex’s SCRA benefits request page. You will then be able to request that the benefit be applied to your account.

American Express then reviews your account to determine your eligibility. When approved, you immediately start receiving the benefits of a capped 6% interest rate, which includes a waived annual fee.

Repeat the process with any banks and lenders you deal with, though you need to contact each one individually.
